Several children have probably been missed in this family. In particular, it is tempting to think that the Pierre Dutoit who was the father of Isaac Dutoit the notary could be among them.

The Abraham son of Pierre Dutoit baptised 31 jul 1625 is clearly one of his children, because of the presence of Pierre's uncle Abraham and brother Jaques. Beyond that, the children of Pierre Dutoit "dit Billet" probably belong here. The other children of "Pierre Dutoit" could belong to at least two other men of the same name.

This is the Pierre of Chavannes whose son Claude carried on a dispute with the heirs of Claude Dutoit son of Jacob over several decades regarding 21 florins that he had to pay for the wedding of Perissone, daughter of Jacob, to Clement Buti. The latest document we found mentioning this long-running dispute was in 1538 (Roulx Demont, notary). Apart from the fact that he was the father of Claude, we know nothing about him. In particular, we have no documents in which he is mentioned during his lifetime. He is not mentioned with the brothers Jacob, Jean, and Rolet (from other sources the sons of Nycodus de Tecto) in a document dated 21 jul 1449 (notary Jean Crepy) quoted in a dispute over the "dixme" of Chavannes before the Cour de Justice de Chavannes in 1680 (ACV BIL 264). He may be the same Pierre Dutoit (Petrus De Tecto, son of Johannes) whose widow Agneis De Laz Cort (de Curia, Delacour) is mentioned 22 jan 1452 (Jean Saly, senior, notary). In that case, as the father of the Dutoit brothers cited several times from about 1446 until about 1460, he would be the son of Johannes. This conclusion seems best to fit the available facts, and we found no clear evidence to place him as another brother of Jacobus, Johannes, and Roletus, sons of Nycodus de Tecto.

In a document of 07 feb 1524 (Rodolphe Demont, notary at Moudon), he conveys rental income to endow the celebration of mass at Chavannes. Along with Claude Dutoit the elder, he is cited in 1520 (Archives communales de Moudon, P, dated the Wednesday after the feast of St. Jaques, signed by the notary Michel Frossard) representing the holders of the "disme" of Chavannes against encroachments by Jacob d'Estavayer, prothonotary of the church of St. Etienne at Moudon. This feudal tax, collected in kind by the owners of the "disme" from specified crops grown and harvested by the tenants on land subject to this tax, was still the property of members of the Dutoit family about two centuries later, having been divided among the descendants to the extent that they owned only a "particule" of the proceeds. The document of 1520 is among the earliest notices of this "disme", but there is also a description from 1449 represented by a much later transcript in French, with the Latin original likely in the communal archives of Chavannes-sur-Moudon.

Later documents seem to indicate that the Dutoit family had title only to a portion of the "disme", namely, the “receverie”, a fee collected by the Dutoit family in return for their services in collecting the disme.

By 1543, Pierre's sons Nicod and Claude had reached the age of majority, for they participate in financial transactions in their own names (Rod Demont, notary).

The marriage contracts for his sons Nicod and Claude are clear. Claude married Antheine, daughter of Roulx Veyre, and Nicod married her sister Françoise. It is in later documents that the situation becomes confusing.

One solution is to believe the records of the notaries regarding the name of the father of the five brothers Nicod, Pierre, Jean, François, and Guillaume who divided property in 1568. The records of the notaries usually call this man Nicod. The church records would then be in error when they call the father Pierre. This solution leads to a further problem, however, since the partage of 1568 says that the name of the wife of the first brother, Nicod, is Françoise Veyre, which is also the name of the wife of their apparent father, Nicod son of the present Pierre Dutoit. The Veyre family is large enough that this could have happened, but it does not seem likely, and would surely have resulted in further epithets such as "the younger" and "the elder" being applied to members of that family.

The other solution, which now seems more likely, holds that the notaries were mistaken about the name of the father, and that he was in fact the present Pierre Dutoit. Then, his son Nicod is found to be married to Françoise Veyre, as stated once in the partage of 1568 (several other passages simply Françoise, with no surname), and the five brothers have an additional brother Claude Dutoit, who could be the son of a different mother, since he does not share property with them, or else he had simply made an earlier division, separately from the other brothers. Under this second solution, the church records are correct, and as a result, the Nicod who married Françoise Veyre becomes the same person as the Nicod who was one of the five brothers.

In either solution, the striking contradiction of the records is puzzling. While the notaries on rare occasion make errors, and while the church records also contain occasional errors, we have never before encountered a case where such an error is consistently repeated. Is it possible that the present Pierre, or perhaps his son, was sometimes known under both names?

A puzzling feature of the partage of 1568 is that it mentions a Claude Dutoit who is or was the "brother" of the five brothers who divided their joint holdings. There are several such mentions: one on fol. 72r says adjacent property at Trelemon is held by the children of "Claude leur frere" — a statement that carries the implication that this Claude has died. Another is on fol. 73v, where the same adjacent property is simply held by "Claude son frere", although sometimes such statements turn out to mean that the property is now held by the heirs of the person named. A third is on fol. 76v, property at Genevray, but there does not seem to be any corresponding mention in the rest of the partage. Now, if the partage is correct in stating that the wife of the brother Nicod was Françoise Veyre, and not some other Françoise, and that they had a brother Claude who had already died, then there were originally six brothers, all sons of the present Pierre. This is possibly the most satisfying result, but it still leaves the difficulty that the partage says the brothers were sons of Nicod!

Another piece of evidence from the partage is that the five living brothers had a cousin Rod Dutoit, mentioned nine times. There is also one mention of a cousin Claude Dutoit. Who is this Rod? If the present Pierre was the father of the five (or six) brothers, then Rod would be the surviving son of Pierre's brother Jean. This Rod had a brother Claude who seems to have died without children, probably well before 1568.

For these reasons, we feel the best solution is to collapse the ancestry that we showed previously for the five brothers, so that the present Pierre is their father, and the two persons previously shown as "Nicod (Pierre)" with wife Françoise Veyre, "Nicod " his son, become one person. That would mean that the present Pierre is the one called in error Nicod in the partage of 1568 and related documents.

A related problem is to establish the heirs of Pierre's son Claude who died before 1559. Because of the presence of several men of the same name, there is a great deal of uncertainty involved. We first thought that Claude's sons should include Jaques ("Gros Jaques") and François, but the terrier ACV Fn 347 (fols. 206 and 236v, 12 oct 1593) tells us that both inherited property that had previously been in the hands of Maurice and Claude Dutoit, sons of Claude. The various citations involving Claude Dutoit in the middle of the 16th Century remain to be reconciled.

First reference is his marriage in 1582, when he is noted as minister at Siens and deacon at Moudon. He is listed then as son of the late Jean Dutoit, but his father is probably not the same "late Jean" whose son Pierre married in 1565, or else there should be more heirs of "the late Jean" appearing in the notarial records. Evidently we are looking for a Jean Dutoit who was alive in 1565 but who had died about 1582. This prospect calls into question the parentage of several other sons of the "late Jean" whose marriages were recorded in 1575, 1579, and 1581.

In his testament, Pierre lists his wife as Anne Frossard. This marriage has not yet been found. In fact, the baptisms of his children have not been found, either, except for those of Marie in 1597 (at Morat) and Dorothée in 1600 (at Moudon). His testament also names his brother Moyse, and his nephew Jean, son of Moyse. His testament makes it clear that his daughter Esther was a child of his second wife, and that his eldest child, Magdelaine, was a child of his first wife. Which mother bore the other children is not clear.

In 1643, his granddaughter Elizabeth Panchaud, daughter of the minister Ulrich Panchaud of Grandson and his wife Magdelaine, daughter of Pierre Dutoit, was the owner (with her husband Jacob DeTrey, son of Guillaume DeTrey) of Pierre's estate near Prevondens. This estate was traded with Michel Butin and his wife Jeanne Rouge for a number of parcels of land that Jeanne had inherited from the estate of her father Jean Rouge and her mother Anne Planche (Samuel DeTrey, notary, 12 may 1643). This transaction explains how the Butin family came to live at Prevondens, and how Jeanne Rouge was later noted as owning a house in her own right.

A document of Anthoine Richard, notary, 27 may 1607 (ACV DL 80), involves a debt previously contracted by George Bourgeois of Courtilles to Jaques Frossard acting on behalf of his "beau-pere" (either step-father or father-in-law) George Dutoit of Vevey (1602). Now, in 1607, Pierre Dutoit, minister at Moudon, is acting on behalf of the late George Dutoit his brother to settle this debt. This must be the George son of Jean Dutoit (not identified as "late") who married Clauda daughter of Pierre Perrin, bourgeois de Vevey, 31 jul 1580, recorded at Moudon.

He served also at Constantine (1591), where perhaps his other children were baptised, and Morat (1596-1598). It does not appear that records for Constantine have survived from such an early date.

About 1619-1620, he seems to have attempted to buy property and acquire the benefits of citizenship (bourgeoisie) at Curtilles, which led to a dispute of some sort. The archives of Curtilles has two documents on this subject, not yet examined.

A document of Jaques Richard, notary, 06 nov 1598, further complicates the picture. It concerns a Pierre DuToict son of "the late Jean", and has Pierre DuToict the minister as one of the witnesses. The first Pierre is exchanging property with Jaques son of the late Claude DuToict of Chavannes, witnesses including also François son of the late Claude DuToict. The notation "fils de feuz hon. Jehan" appears as a marginal addition in the register, but does not appear in the draft of this document in the corresponding minutaire. There are a number of other references at Moudon and Vevey that mention a Pierre Dutoit son of the late Jean who is not the minister.

A possible clarification of the problem of the two "late Jean Dutoits" is in the marriage register at Granges. There are two Dutoit marriages in 1582: Louise, daughter of the late Jean Dutoit bourgeois of Moudon and Vuarmarens, parish of Morlens (now in Canton Fribourg) marries Claude Rod (Roud? Roux?), and Pierre son of the late Jean Dutoit of Chavannes (the minister) marries Anne Gillian. The wording may be intended to distinguish between the two men of the same name, living in different villages.

A document of Clement Butty, notary at Vevey, 12 oct 1591, has Doct, Sage, et Prudent Pierre Dutoit son of the late Jean Dutoit of Moudon, minister at Constantine, selling vineyards to his brother George Dutoit, cordonnier and bourgeois de Vevey.

He survived the plague in 1613, as explained in the following inscription in his hand in the baptismal registers at Moudon:

Resident at Vevey 1595, named as cousin of Pierre son of the late Louis Dutoit of Vuarmarens. Several transactions extant for this Pierre son of Thomas at Vevey in 1595-96, Clement Butty, notary. In the early 1600's, there are a number of references at Vevey of Pierre Dutoit the younger and Pierre the elder, and by 1610, further references to Pierre Dutoit son of the late Thomas or son of the late Louis. Based on the information available so far, he seems to be Pierre who married Salomé Rubattel.

He made a "reconnaissance" on 22 mar 1592 (ACV Fn 347, fol. 40v) that idenfies him as a son of the late Jaques who was a son of Claude Dutoit. Some of the property had previously been recognized (circa 1567) by Claude son of Pierre Dutoit. The Pierre who made the reconnaissance in 1592 had brothers Antoine and Jaques, and possibly another brother Jean as well (mentioned as Jehannod in the reconnaissance of Jaques). Another reconnaissance of the same date is in Fn 349, fol. 439v.

Son of late Jean Dutoit of Chavannes, according to the marriage record in 1565. Which of the Jean Dutoit's was then "the late" is open to question. Except for the marriage record itself, nothing is certain about this Pierre. He was probably the father of Daniel (1568) and probably also of most of the children of Pierre Dutoit "of Chavannes" who were baptised as late as 1586, but it is possible some of them belong to Pierre Dutoit the minister, who may have been married prior to 1582 (and whose father was a later "late Jean Dutoit").

The marriage contract recorded 24 aug 1565 by Jean Jaqueri identifies him as Pierre son of the late Jean Dutoit of Chavannes, and notes that Pierre's brother Louis was present at the signing. The name of his brother, apparently the only Louis Dutoit in the area at this time, places him in the present family. The bride is described in the same document as the daughter of the late Mauris Dutoit, represented by her uncle Claude Dutoit and her brother Jean Dutoit.

Based on the additional "reconnaissance" in which he is represented by his son Daniel (ACV Fn 347 fol. 381v, 17 apr 1595), he must be the Pierre son of Jean Dutoit whose reconnaissance in the same terrier is dated 12 oct 1593 (fol. 7). This identification is virtually certain, as there is no other Pierre son of Jean Dutoit in this terrier. By this time, Daniel had reached the age of majority. Most of the property recognized by Pierre in 1593, beginning on fol. 7, had been recognized in a terrier compiled by François Collon, probably about 1540, by Pierre and Jean, sons of the late Nicod Dutoit.

Son of the late Anthoine Dutoit (1627), son of Jaques. Pierre had a brother Jaques who was living at Estavayer in 1627. He was not Pierre the hoste de la Croix Blanche. He was not the father of Gaspard Dutoit b. 1613. This Pierre had an uncle Pierre who was son of the late Jaques Dutoit (1632). He is not the minister. His brother Jean married Claudaz Chappuis by 1636. As late as 1651, he appears in various notarial records as Pierre son of Antoine who was the son of Jaques Dutoit.

On 03 apr 1632 (same notary), Claude Chappuis, bourgeois of Moudon, afflicted with illness, donated property to the children of Pierre son of the late Antoine Dutoit of Chavannes, mentioning also Susanne Mojonner, mother of these children. He had obtained his property from Pierre in the course of a "discution des biens", evidently a settlement among Pierre's creditors in this instance. By 15 jun 1632, Pierre son of the late Antoine donates to his wife Susanne his portion of the estate of the late Pierre Dutoit his uncle, son of the late Jaques Dutoit. So far, the names of the children have not been located in any of the documents relating to these transactions.

The records of the notary Jaques Crausaz of Moudon include a document of 13 dec 1680 regarding Daniel Dutoit "the elder" and his "beaufils" (step-son or son-in-law) Daniel Dutoit "the younger". This Daniel Dutoit "the elder" has a brother Jaques Dutoit dit "ès Jaques". This statement indicates we are missing a baptism for a missing son Daniel. Unfortunately, the baptisms recorded at Moudon in this era give very little information, so many remain unassigned.

A document that appears in a minutaire attributed to Faucherres, notary at Moudon, as well as the registre of Benoit Giraudet, 21 apr 1651, shows that Pierre had title to a portion of a fief that had originally been sold by the Noble de Prez brothers in 1559 to various members of the Dutoit and Vayre families. One of these sales in 1559 was to Jaques son of the late Claude son of the late Pierre Dutoit. If the grandfather of the present Pierre were born soon enough, say before 1540, it would be logical to identify him, and the origin of the "ès Jaques" branch of the family, with the Jaques who purchased the interest in the fief in 1559.

An additional sale, 28 feb 1645, has Pierre ceding to Gaspard Nicaty, Curial and bourgeois de Moudon, a part of the dîme of Chavannes from his grandfather, Jaques Dutoit, "avec la particule que cy devant possedoit Jean Duc, qui appartient maintenant à honnorable Jean fils de feu honnorable Daniel Dutoit de Chavannes", reserving a particule that belonged to "a certain Roulet".

A settlement recorded 18 feb 1633 (Jean Morel, notary at Vevey) concerns a dispute about an old debt between the late Noé Guédon and the Crochat family. The children of Noé are represented by his widow (not named) and her brother Pierre Dutoit of Vevey. About 1610, there are two Pierre Dutoit's who have bourgeois status in Vevey, generally known as the elder and the younger, or else the son of the late Louis or the son of the late Thomas. The key to understanding which Pierre is which is found in the testament of Claudaz Savoye, 26 nov 1628, "mallade et affligée de peste", recorded by notary Jean Maquelin. She is the widow of Pierre Dutoit "le jeune", and names children Louis (logically, named for his grandfather), Noel (logically, named for Noé Guédon, his uncle), and François. This hinges on the early death of Pierre's first wife, Jaquemaz Michoud, not unlikely but not confirmed either. Unfortunately, the other Pierre seems also to have had a wife named Claudaz, his widow as early as 1615.

Pierre DUTOIT       (ID #I2086)

Pierre the brother of Elie is noted as Tisserand or Tissot before 1620, hoste after that. He is cited in a large number of documents at Moudon. By 1629, his brother Elie is tuteur of his children. This Pierre is also known as "the younger", and apparently also as "officier de Moudon" 1620-1621. This conclusion depends on identifying the godson of the elder Gaspard Dutoit baptised in 1613 with the son of Pierre hoste mentioned after his death; the godson mentioned in the elder Gaspard's testament is son of the officier!

In order to establish whether all of these Pierre Dutoits can be the same man, it is necessary to pay attention to exact dates in the various citations:

25 apr 1624 (Baltazard DeCristaz, notary at Moudon): Pierre Dutoit bourgeois et hoste de Moudon sells land at Vulliens to Abraham Burnand. (Pierre is also mentioned in the baptismal records of Moudon—on occasions when he appears as a sponsor—as the hoste at La Croix Blanche, 1624-1626.)

25 nov 1627 (Baltazard DeCristaz, notary at Moudon): Pierre son of the late Antoine Dutoit of Chavannes sells his share of an estate held in common with Jaques Dutoit his brother, to Pierre Dutoit hoste. This record proves that Pierre the hoste is not the son of Antoine.

25 feb 1629 (Baltazard DeCristaz, notary at Moudon): Susanne daughter of the late Gustin (Augustin) Socquet vivant bourgeois de Moudon wife of Samuel Monney of Bienne (absent, hors du pays at this date), with her uncle Jaques Combremond, and Jaques Socquet her nephew, cedes to her brother-in-law Pierre Dutoit, hoste at La Croix Blanche and bourgeois of Moudon, any interest that she may have in the estate of the late Maître Jean Amioti vivant bourgeois d'Estavayer and resident of Lausanne, son of the late Vuillemoz Amioti, vivant bourgeois d'Estavayer, for 100 florins. She does this, apparently, out of gratitude for Pierre allowing her and her children to live in his house at Moudon. Among other things, this record suggests that the name given as Sacquet in the church records at Moudon should be taken as Socquet. The same notary mentions debts to Pierre Dutoit, hoste at Moudon, 07 apr 1629 and 13 apr 1629.

09 nov 1629 (Jaques Jayet, notary at Moudon, ACV DL 57/3 fol. 64): Marguerite Menouz widow of the late Pierre Dutoit vivant bourgeois de Moudon seels to Jean Duc of Villardbramaz, "assavoir, generallement tous et ung chescungs les biens à ladite venditrice donnez et remis en payement pour ses droictz dotaux par Elie Dutoict tutheur des hoirs dudit feu Pierre Duthey son feu frere siz à Chavannes..." for a price of 8000 florins. Unless there was another Pierre of that era with a wife Marguerite, this would indicate that Pierre died between April 13 and November 9 of 1629. This transaction, incidentally, explains how the Duc family of Villars-Bramard became established at Chavannes-sur-Moudon.

16 nov 1629 (Baltazard DeCristaz, notary at Moudon): Jean Rey, Lieutenant de Carrouges, owes Marguerite, widow of the late Pierre Dutoit vivant bourgeois de Moudon for 3 cows. Among other documents about the same time confirming the death of Pierre Dutoit, 26 nov 1629 (same notary), Marguerite widow of the late Pierre Dutoit "vivant hoste et bourgeois de Moudon" owes Daniel Montet bourgeois de Lutry for wine (the main, or perhaps the only product of Lutry). Likewise, 07 dec 1629, Pierre Goley owes Marguerite Menod widow of the late Pierre Dutoit hoste, for a horse. Even more precise, but somewhat difficult to believe, he is apparently alive in documents of 24 and 25 sep 1629, but listed as "the late" Pierre on 26 sep 1629, documents of Balthazard DeCristaz!

07 dec 1646 (Benoit Giraudet, notary at Moudon): Pierre Dutoit bourgeois de Moudon hoste at Dompreloye (modern Donneloye) with his wife Marguerite Malingre and her nephew Spectable Abraham Malingre sell a house to Daniel Berchery bourgeois of Moudon on the Rue de Rostoborgeaux. This proves that there were two Pierre Dutoits who were "hostes" (innkeepers), both with wives named Marguerite! The identity of the second one has not been determined. Is it possible the second is the son of the first?

We finally located one document that proves the Pierre Dutoit who married Marguerite Menoz is the same one who had earlier married Catherine Socquet. The records of Jaques Jaquier, notary at Moudon, contain a settlement regarding "difficulties" that had arisen between Marguerite Menoz, widow of Pierre Dutoit, hoste, and Gaspard and Marguerite, his children by his first wife Catherine Socquet (ACV DL 52/1 fol. 251, dated 08 oct 1629). In addition, we found an appearance of Marguerite, wife of Pierre Dutoit, hoste at La Croix Blanche, in the baptismal records for Moudon, 21 jun 1629.

As a result of these discoveries, we can place Pierre's death between June 21 and October 8, 1629, and possibly during the night of 25-26 September, 1629.

[806] He is apparently alive in documents of 24 and 25 sep 1629, but listed as "the late" Pierre on 26 sep 1629, documents of Balthazard DeCristaz, notary.

Possibly dead by April, 1632, as implied in a donation of Claude Chappuis of Moudon to Pierre son of Antoine Dutoit, 05 apr 1632 (Baltazard DeCristaz, notary of Moudon). Baptism specifies father as Jaques son of Claude Dutoit.

Occupation variously listed, also chamoiseur. One baptism lists him as "Visguébé", an word used at least once interchangeably with chamoiseur. It might have something to do with the production of fine "white" leathers. The deciphering of this puzzling passage allows us to identify a few other passages where either Pierre Dutoit or Isaac Dutoit (presumably his son) appears with this title in various spellings. A baptism 22 jul 1638 could be his, but does not list the mother's name or the father's occupation.

[983] Possibly he was the child of Antoine Dutoit of Moudon baptised 22 jul 1638, the given name of the child not recorded.

[14460] Marriage contract recorded 23 aug 1662 by Benoit Giraudet, notary at Moudon.
