Hugh must have been married more than once, because his widow would only have been four years old when his first son was born. It is not yet clear which children would belong to which marriage, and the name of the first wife is not known. The birthdates of about half of the children appear to have been estimated, based possibly on the assumption that they have been listed in order in the will dated 20 jan 1825. However, that does not appear to be the case.
Will of Hugh Abernathy, Union Co., Indiana (Vol. 1, p. 24-26):
I, Hugh Abernathy, a citizen of the County of Franklin in the State of Indiana, do declare this my last Will and Testament, revoking all others. First, All my debts are to be punctually and speedily paid, and the legacies herein bequeathed are to be discharged in the manner directed therein. To my dearly beloved Wife Mary Abernathy, her heirs and assigns forever, I bequeath my whole Estate both real and personal except such parts thereof as are hereinafter otherwise disposed of, the same being given to her instead of her dower. Item: Having heretofore given to each of my two sons John Abernathy and Robert Abernathy a tract of land worth five hundred Dollars, the title whereof is hereby further confirmed to them, their heirs, and assigns forever, I hereby give and bequeath unto the said John and Robert one Dollar each to be paid out of the proceeds of my Estate. Item: To my daughter Isabel Bolan, I give and bequeath one dollar to be paid out of the proceeds of my Estate, having heretofore given to her Sundry goods and chattles to the value of at least twenty five dollars. Item: To each of my three daughters, Nancy Rusing, Jane Morrow, and Sally Rusing, I give unto and bequeath one dollar, having heretofore given to the said Nancy, Jane, and Sally Sundry goods and chattles, and some cash to the value of at least twenty dollars each, it being as I believe their equitable Share of my Estate. To my daughter Nelly Abernathy, I give and bequeath a certain desk now in my house worth ten dollars, two beds now in my house each worth five dollars, one white cow now on my farm worth Eight Dollars and one white and red cow also now on my farm worth six dollars, provided that if at my death I should not be possessed of all or either of the aforementioned articles, there shall be paid to her in cash out [of] proceeds of my estate the sums annexed to them respectively for such as I may be destitute of. Item: To each of my three sons James Abernathy, William Abernathy, and Benjamin Abernathy I give and bequeath one dollar, having heretofore given to the said James, William, and Benjamin each a tract of land Situate in the County of Franklin and State of Indiana, each worth at least one hundred Dollars, the title whereof is hereby further confirmed to them, their heirs, and assigns forever. Item: To each of my two sons Richard and Thomas Abernathy, I give and bequeath one Dollar, having given to each of them heretofore property to the value of one hundred dollars. Item: To each of my two sons Moses and Kilam Abernathy, I give and bequeath one dollar, having recently given each of them one hundred in cash. Item: to my Grandson William Burns I give and bequeath one Dollar, having heretofore given to his mother Mary Burns formerly Mary Abernathy during her lifetime sundry goods and chattles to the value of twenty five dollars. Item: To my two sons George and Samuel Abernathy I give and bequeath the farm on which I now live, it being a part of the East half of the north east quarter of Section Ten in Township Ten of Range two West of the Meridian line drawn from the mouth of the Great Miama River, but untill they both arrive to the age of twenty one years, I wish it to be destinctly understood, that their mother shall have the privilege of occupying the samd farm should she so long live, and to appropriate the rents and profits thereof to her own support and to the support and education of the said George and Samuel, whom I desire may remain with their said Mother until they arrive to the age of twenty one years respectively. In case either the said George or Samuel should decease previous to his arriving to the age of twenty one years if he should leave no children, his part shall accrue to one who survives. In case the said George and Samuel should both decease before they shall have arrived to the age of twenty one years and leave no children, the said farm is hereby given and bequeathed to my said Wife during her life time and to her heirs and their heirs and assigns forever. In case there should not be monies on hand or recoverable debts sufficient to discharge my past debts, and the several legacies herein bequeathed, I direct so much of my personal estate to be sold and turned into cash as may be necessary for the same. Lastly, I constitute and appoint my son Robert Abernathy and my son-in-law Robert Rusing Executors of this Will and Testament. In testimony whereof I have hereunto set my hand and affixed my seal this twentieth day of January in the year of our Lord one thousand Eight hundred and twenty five.

What can be deduced from the will? First, sons John and Robert have been treated equally, each has been given a tract of land valued at $500. (Deeds corresponding to these and the other bequests need to be identified in the records of Franklin and Union counties.) The next group of sons, James, William, and Benjamin, each received a tract of land in Franklin Co. worth $100. Sons Richard and Thomas have each received property worth $100. The next two sons, Moses and Kilam, have received $100 in cash. Finally, the two minor sons George and Samuel, both under the age of 21, will eventually divide Hugh's farm in Union Co. In other words, John and Robert are singled out from the others, even though Robert actually seems to be the third son. The daughters fare rather badly by comparison. It is apparently assumed that they will be provided for by their husbands.
Apparently in Iowa as early as 1838, per 1856 state census. That his wife Rebecca Smith is the daughter of John Smith and Elizabeth Chapman is established by the presence of her brother Joel Smith in the same household in 1856, by the names of her children, by the John B. Smith probate records, and by a family story about a member of the family who got tangled up with the Mormons, escaped, and published her story -- that would be Mary Ettie Coray, wife of Rebecca's brother Reuben Peace Smith! 03 aug 1863: Deed (vol. M, pp. 570-572) recounts that on 07 mar 1861, Hugh Abernathy and his wife Rebecca filed a petition in the District Court of Davis Co. against Henry C. Smith, John Casady and Rachel Casady, Henry C. Smith as guardian of John C. Smith, John Casady as assignee of Hugh D. Smith, Joel J. Smith, and William J. Smith, praying partition of the SW 1/4 Sec. 13, T 68 N, R 12 W, in Davis Co., and a part of the SE 1/4 Sec. 7, T 68 N, R 11 W on the south side of the Fox River in Van Buren Co. (about 140 acres), being part of the estate of John B. Smith; and at the March term 1862 of the District Court, referees John Wilkinson, Bushrod W. Craven, and Josiah I. Earhart were appointed to partition the said real estate; the referees reported at the September term 1862 that any partition would diminish the value of the property, and so a sale was ordered, preceded by a public notice in the Democratic Clarion, a newspaper in Davis Co.; the sale was held 17 mar 1863, and the property was purchased by the highest bidder, Henry C. Smith, $750 for the land in Van Buren Co. and $900 for the land in Davis Co. [This transaction is somewhat puzzling, because the deed of 16 nov 1861, in which Hugh and Rebecca sold their right, title, and interest in the John B. Smith estate to Henry C. Smith, should have rendered their petition of 07 mar 1861 moot. In fact, it appears that all of the heirs, with the exceptions of Reuben P. Smith, who was in Utah and California, and of John C. Smith, who was not competent, had already sold their interests to Henry C. Smith, and so none of the heirs would have been expected to make further demands on the estate. The probate records for the period 1861-1863 have not been examined yet. The possible contents of the probate case file have not been investigated. If a distribution was made after the court-ordered sale, receipts from each of the heirs should be in the case file.]

Burchett, for $2,900, 5 parcels of land as follows: (1) 50 acres in E 1/2 NE 1/4 Sec. 12, T 68 N, R 12 W; (2) NE 1/4 NW 1/4 Sec. 13, T 68 N, R 12 W; (3) NW 1/4 NW 1/4 Sec. 13, T 68 N, R 12 W; (4) SE 1/4 NW 1/4 Sec. 13, T 68 N, R 12 W; and (5) 6 acres in NW 1/4 of Sec. 13, T 68 N, R 12 W. This transaction appears to represent Hugh and Rebecca's departure from Davis Co.
The cemetery transcript indicates only the year of death. There do not seem to be death records at this period for Clark Co., MO. Not certain who his parents are, but 1895 Iowa State Census listing in Riley Tp., Ringgold Co., IA, shows he was born in Van Buren Co., IA. Transcribed records of Mt. Ayr cemetery in Ringgold Co. indicate he was a Civil War veteran, but give no dates or his unit. However, there is a poorly legible "Ira" or "Isa" Abernath in the 1850 census, and it is known the parents, Richard and Lucinda Abernathy, were dead before 1860.
[6128] Census ages are inconsistent, could be as late as 1853. However, statement that he was born in Van Buren Co. limits the possibilities, so we have taken the listing from the 1850 census as definitive.
