1850 Census, Prairie Tp., Davis Co., shows James Abernathy born in South Carolina, no wife, but with an apparent daughter Mary Smith with her daughter Rebecca Smith, and an apparent son William T. Abernathy. An earlier census exists, for 1847, listing James Abernathy in a household consisting of 2 persons. Since his son Hugh and his presumed daughter Mary are evidently listed separately with their spouses, the one remaining Abernathy still living with James would be William T. The land that James Abernathy entered in the 1840's was sold to William T. Abernathy in 1848. When William later sold the land in 1855, a graveyard was mentioned. Eventually, the graveyard was located, and proved to contain only one resident, James Abernathy himself. The stone was broken, but the lettering appears to be perfectly legible, and gives the death date 1853, as well as a gloomy inscription, "In the midst of Life is Death". With this information, it becomes apparent that the James Abernathy (born about 1790, in Indiana, according to this census, the birthplace certainly not believable) of about the same age listed in the 1860 census of Rush Co., IN, must be someone else! The existence of two James Abernathy's of the same generation with connections to Rush Co. immediately suggests that the Abernathy family must be more complicated than has previously been supposed. It is not reasonable that both James are the sons of the elder Hugh Abernathy!
James Abernathy obtained patents for three parcels of land in Rush Co., IN:
W 1/2 NE 1/4 Sec. 22, T 14 N, R 9 E, 15 nov 1830; E 1/2 SE 1/4 Sec. 11, T 14 N, R 9 E, 17 apr 1833; SW 1/4 Sec. 15, T 14 N, R 9 E, 05 aug 1834.
None of the patents indicate a previous place of residence.
The second parcel listed above, in Section 11, was sold by James Abernathy and his wife Elizabeth 02 apr 1831 to Nathan Porter of Kenhawha (Kenawha) Co., VA for $150.
The W 1/2 of the parcel listed above in Section 15 was sold by James Abernathy (no wife listed, so she was presumably already dead) to Hugh Abernathy 28 nov 1835 (Rush Co. Deeds, vol. F, p. 601) for $350 "and for mutual love and affection". This deed refers to Hugh Abernathy as the son of James Abernathy. Hugh Abernathy and his wife Rebecca sold this 80 acres 19 apr 1839 to William M. Fleener for $700 (vol. K, p. 20). The E 1/2 of the same parcel was sold by James Abernathy to William M. Fleener 03 may 1840 for $550 (vol. K, p. 492).
James Abernathy also purchased 80 acres adjacent to his property in Section 22, the E 1/2 NW 1/4 Sec. 22, T 14 N, R 9 E. He sold the two properties in Section 22 on 13 may 1845 to William Lytle of Butler Co., OH for $1600 (vol. O, pp. 112-114). The sale notes the existence of a cemetery in the E 1/2 NW 1/4 Sec. 22, which is excluded from the sale. This cemetery, if it can be located, should be the burial place of James' wife. The date of this sale probably marks the departure of James Abernathy from Rush Co.
So far, it is assumed that this James Abernathy is the son of Hugh Abernathy and his wife Mary who came from South Carolina to the area that is now Union County, Indiana by 1809. This area has been, successively, Dearborn, Franklin, Fayette, and finally Union Counties, and records concerning Hugh and his family should be sought in all of these jurisdictions. The first patent, in the name of Hugh Abernathy and William Rusing (probably father of the husbands of two of Hugh's daughters), is dated 1809, in Section 21, T 10 N, R 2 W. The accounting of all the parcels of land owned by Hugh Abernathy has not been completed, but we note that he and his wife Mary sold to James Abernathy in 1817, land in Sec. 32, T 13 N, R 13 E, in present-day Union County (Deeds vol. B, p. 430).
Hugh Abernathy "of Franklin County, Indiana" made his will 20 Jan 1825. It was probated in Union County in 1826. Letters Testamentary were granted in recess by the probate court there before the August term, 1826, to Robert Abernathy and Robert Rusing. The will, as abstracted in the Hoosier Journal of Ancestry, 7(4): 24, shows the following heirs:

The will mentions the "farm where I now live", in the E 1/2 NE 1/4 Sec. 10, T 10 N, R 2 W.
How many children did James Abernathy have? By combining the various census records, evidence for 7 children is found:
1. A daughter born 1811-1815, gone by 1840 2. Hugh Abernathy, b. 1814 3. A daughter born 1816-1820, gone by 1840 4. A son born 1816-1820, and here presumed to be Richard Abernathy b. 1817, already in Iowa in 1839 5. A son born 1821-1825, still in the household in 1840, but no evidence that he survived beyond that date 6. Mary, b. about 1824 7. William T. Abernathy, b. about 1830.
Since four children were born between the middle of 1810 and the middle of 1820, the date of James' marriage was likely about 1811, and the marriage would likely have been recorded in Franklin Co., IN. The records there may not be complete, and he is not listed. Records for adjacent Ohio might also be checked.

The first wife of Reuben Peace Smith, named as Mary Smith in the deed of 1849 in which Reuben Smith sells back to his father 50 acres of land in Prairie Tp., Davis Co., IA which he had purchased in 1847 from his father. Her probable identity as Mary, daughter of James Abernathy, is deduced from her residence with James Abernathy in the 1850 census, but no probate or land records have yet been located to confirm this hypothesis.
